Welcome to expo. These Terms of Service ("Terms") govern your use of our desktop-based file search engine ("Service"). By accessing or using expo, you agree to be bound by these Terms.
1. Acceptance of Terms
By downloading, installing, or using expo, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.
2. Description of Service
Expo is a desktop-based file search engine that sends file content of users' selected folders to Microsoft Azure and OpenAI to enable search functionality. The Service does not collect any personal data or usage data.
3. User Responsibilities
Selection of Folders: You are responsible for selecting the folders you wish to include in the search. Ensure that the files you choose do not violate any laws, third-party rights, or include prohibited content such as nudity or criminal activities.
Compliance with Laws: You agree to use the Service in compliance with all applicable local, state, national, and international laws and regulations.
Security: You are responsible for maintaining the confidentiality of your data and for any activity that occurs under your use of the Service.
4. Prohibited Actions
Users are prohibited from:
Reverse engineering our code and search algorithm.
Gaining unauthorized access to the Service.
Selecting folders containing prohibited content such as nudity, crime, etc.
5. Data Transmission
To enable search functionality, the file content of your selected folders will be transmitted to Microsoft Azure and OpenAI using the HTTPS protocol. By using the Service, you consent to this data transmission.
6. Limitation of Liability
Expo is provided "as is" and "as available" without any warranties, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. To the fullest extent permitted by law, expo disclaims all warranties, express or implied, regarding the Service, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
7. Indemnification
You agree to indemnify, defend, and hold harmless expo inc. and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.
8. Termination
We reserve the right to terminate or suspend your access to the Service, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
9. Changes to Terms
We may modify these Terms at any time. If we make changes, we will notify you by email or through the Service. By continuing to use the Service after the changes become effective, you agree to be bound by the revised Terms.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of Japan, without regard to its conflict of law principles. You agree to submit to the personal and exclusive jurisdiction of the courts located in Tokyo, Japan to resolve any dispute or claim arising from these Terms.
11. Ownership and Intellectual Property
This software is owned by the expo development committee. All rights, title, and interest in and to the Service, including all intellectual property rights, are and will remain the exclusive property of expo inc. and its licensors.
